This is the last Will and Testament
of me Joseph William Pracy of No.95 Mildmay Road
Kingsland in the parish of Saint Mary Islington in the County of Middlesex
Soap Maker In the first place I direct the payment of all my just debts
and funeral and testamentary expenses as soon as convenient can be after my
decease Subject to any bequests of any parts thereof by this my Will made
I give and bequeath the whole of my household furniture plate linen china jewels
ornaments and wearing apparel to my daughter Mary Ann Elizabeth Pracy absolutely
but if she shall think fit so to do to give portions thereof to my other
daughters Jane Ellen Pracy, Elizabeth Jane Pracy, and Emily Pracy I give and
bequeath unto my said daughter Emily Pracy my pianoforte I give and bequeath
to my son Thomas Richard Pracy my gold watch and chain I give and bequeath
to my son Henry Edward Pracy my opal scarf pin I give and bequeath to my
said daughter Mary Ann Elizabeth Pracy my diamond ring I give and bequeath
one half part or share of my interest of and in All those leasehold messuages and
premises situate and being No.4 and 5 New Inn Street in the parish of Saint
Leonard's Shoreditch in the said County of Middlesex for all the estate and ____?
I shall have therein at the time of my decease also one half of all that my
share and interest in the Goodwill of the business of Soap Makers now carried on
by me and by my son Thomas Richard Pracy under the style of firm of G.
Brown &Co and of the machinery implements utensils stock and effects connected
therewith book debts money in the house or on my person or in any bank
or banks at the time of my decease Unto my said son Thomas Richard
Pracy his heirs executors and administrators absolutely And I declare and
direct that the said business shall be carried on by my said son Thomas
Richard Pracy only without the interference of but for the benefit of himself
and of the other parties interested therein as hereinafter mentioned I direct that
as soon as conveniently may be after my decease my Executors and Trustees
shall cause an account and valuation to be made of my interest in the said
leasehold premises and in the goodwill of the said business and of the machinery
implements utensils stock and effects connected therewith and of the debts due
therefrom and thereto with an estimate of the debts due thereto and also an
account of all other my estate and shall deliver Copies thereof to such of my
children as are interested therein as hereinafter mentioned and also shall once
in every year prepare a balance sheet showing the profits accruing in the
year on account of the said business which account shall be signed by all
the parties entitled to participate in that portion of my estate As to the
other half of my interest in the said household premises and in the Goodwill
of the said business and of the machinery implements utensils stock and effects
connected therewith book debts money in the house or on my person or in
and Bank or Banks at the time of my decease and not hereinbefore disposed
of I give and bequeath the same unto my Trustees hereinafter named Upon
trust in the first place out of the profits of the said half of my said share
and interest in the said business to pay and allow my said daughter Mary
Ann Elizabeth Pracy sufficient money to pay the rent rates and taxes of the
dwellinghouse in which she may reside but so that the total allowance for
such rent rates and taxes shall not exceed in any one year Sixty pounds in
the whole I further declare that my trustees or trustee shall stand possessed
of and interested in the profits from time to time to arise from the said
half of my share and interest in the said business Upon the trusts herein-
after declared of and concerning the same that is to say Upon trust out of
the said profits of the said half of my share and interest in the said
business and after the payments aforesaid to pay to each of my said daughters
Mary Ann Elizabeth Pracy and Emily Pracy during their natural lives
 

 
respectively the sum of One pound per week Also Upon trust during each year
to pay to them the said Mary Ann Elizabeth Pracy and Emily Pracy in equal
shares and proportions such portion of the profits on the said half of my
share and interest in the said business as may be mutually agreed upon between
my said son and daughters after deducting from the said half of my said
share whatever sum (not exceeding Sixty pounds per annum) my Executors and
Trustees may have paid to my said daughter Mary Ann Elizabeth Pracy for
rent rates and taxes as aforesaid and also the said sum of one pound so to
be paid to my said two daughters as aforesaid weekly and every week In the
event of my said daughter Emily Pracy marrying at any time then my wish
is and I direct my Trustees to pay unto my daughter Jane Ellen Pracy if
she be unmarried and for her sole and separate maintenance the sum of twenty
six pounds per annum out of the share that my said daughter Emily Pracy
may take under this my Will but I also direct that in the event of my
said daughter Jane Ellen Pracy being married before my said daughter Emily
Pracy or in the event of my said daughter Jane Ellen Pracy marrying at
any time after the marriage of my said daughter Emily Pracy then and in
either of such cases my said daughter Jane Ellen Pracy is not to derive
any benefit whatever under this my Will Subject to the payments aforesaid to
my said two daughters Mary Ann Elizabeth Pracy and Emily Pracy during
their natural lives out of the profits deriving from my said half share and
interest in the said business I give and bequeath the said half share of
my interest in the said leasehold premises and in the Goodwill of the said
business and of the machinery implements utensils stock and effects connected
therewith book debts money in the house or on my person or in any bank
or banks at the time of my decease and so valued and taken into
account as aforesaid to such person or persons as either my said two
daughters shall by her last Will and Testament! or any Codicil thereto and
so far as regards her share only therein nominate and appoint My wish
and intention being that my said two daughters are to have the absolute
disposal of the said half part or share in equal proportions I desire and
my wish is that if at any time my daughter Elizabeth Jane Jones the wife
of James Darcy Jones should require pecuniary assistance that all those of
my children who are interested under this my Will and have it in their
power to assist my said daughter Elizabeth Jane Jones will assist her
according to their ability With regard to my son Henry Edward Pracy I
desire that so long as he remains and works in the said business he shall
be paid weekly fair and reasonable wages gradually increasing in amount
until the said Wages shall amount to two pounds per week And I wish
my said son Thomas Richard Pracy to do the best he can for his brother
the said Henry Edward Pracy either by giving him a bonus at the end of each
year or in such other manner as he shall think fit and so long as he
shall consider the said Henry Edward Pracy desires the same As to all the
rest residue and remainder of my estate whatsoever and wheresoever both real
and personal and whether in possession ____? remainder or expectancy?
I give devise and bequeath the same as to one half thereof to my said son
Thomas Richard Pracy his heirs executors and administrators absolutely and as
to the other and remaining half thereof unto my said two daughters Mary
Ann Elizabeth Pracy and Emily Pracy their respective heirs executors and
administrators in equal proportions and for their sole and separate use benefit
and disposal absolutely I declare and direct that such of my children as are
daughters and take any interest under this my Will that their shares shall
 



be free from the control debts engagements or interference of any husbands to
whom they may be married or with whom they may hereafter intermarry
and the receipt of my said daughters alone shall be a sufficient discharge for
any money paid to them by my Executors and Trustees under this my Will
I further declare that on any Trustee or Trustees declining to act in the trusts of
this my Will or dying or being about to reside abroad or becoming incapable to
act in or being desirous of relinquishing the trust the surviving or acting trustees
or trustee their his or her executors or administrators may appoint a new trustee
or new trustees as occasion shall require and who may act in the same manner
and with the same power and provisions as if named in and appointed by this
my Will I further declare that my Executors and trustees for the time being shall
only be answerable for their own respective wilful defaults and not for the
other or others of them or for the acts receipts or defaults of the other or others
of them and in particular that no Executor or trustee in good faith paying
over money to his Co-Executor or Co-trustee or doing any act facilitating receipt
thereof for the purposes of the trust shall be answerable for the misapplication or
nonapplication thereof and that they may respectively reimburse themselves and
the other executors or trustees all costs and expenses incurred in or in relation
to my Will or the trusts thereof I hereby nominate constitute and appoint my
said son Thomas Richard Pracy and my said daughter Mary Ann Elizabeth
Pracy to be my Executor and Executrix and Trustees of this my Will And
lastly revoking all former Wills and testamentary dispositions by me at any time
heretofore made I declare this only to be my last Will and Testament In witness
whereof I have to this my last Will and Testament written on five sheets of
paper set my hand the seventeenth day of January one thousand eight hundred and
seventy seven ---  Joseph W. Pracy  --- Signed by the said Joseph William
Pracy the testator (as well at the end thereof as on every of the preceding four
sheets) as and for his last Will and testament in the presence of us present at
the same time who at his request in his presence and in the presence of each
other have hereunto subscribed our names as Witnesses ---  Edwd. Vann Solr.

Proved at London the 3rd May 1879 by the Oaths of Thomas Richard
Pracy the son and Mary Ann Elizabeth Pracy the daughter
Executors to whom Admon was granted.
